Terms of Service

By registering for an account with FreeCashCafe.com, you acknowledge that you agree to the following terms and conditions. It is your responsibility to read, understand, and agree to the FreeCashCafe.com terms of service, as well as the FreeCashCafe.com privacy policy. Furthermore, it is your responsibility to note and comply with any future amendments to these two documents. This agreement sets out the legally binding terms of your use of the FreeCashCafe.com website. In the event of any inconsistency between the privacy policy and this agreement, this agreement takes precedence. Nothing in this agreement shall be deemed to confer any rights or benefits to any third-parties. If you do not agree to be bound by the FreeCashCafe.com terms of service, you may not use, subscribe to, or participate in the FreeCashCafe.com program.

Description of Service

FreeCashCafe.com provides users the opportunity to register for a free account and complete promotional offers provided by certain third-party advertisers in return for monetary compensation. These third-party offers must be accessed from the links provided on the FreeCashCafe.com website in order for the registered user to receive compensation. The FreeCashCafe.com website and service shall be provided on an "as is" and "as available" basis. FreeCashCafe.com disclaims all responsibility and liability for the availability, timeliness, security, and reliability of the Service. FreeCashCafe.com reserves the right to change, suspend, or shut down the Service with or without notice, at any time, for any reason, and without any liability to the owners or employees of FreeCashCafe.com. All decisions regarding the service or any user's account will be made at the sole discretion of the FreeCashCafe.com administrators.

User Eligibility

Due to the Children's Online Privacy Protection Act of 1998, you must be 13 years of age or older to participate in FreeCashCafe.com. Users between the ages of 13 and 18 are responsible for obtaining consent from a parent or legal guardian before registering for an account with FreeCashCafe.com. FreeCashCafe.com is open to United States, Canada, and United Kingdom residents only and is void where prohibited by local governing laws. To ensure the quality of the FreeCashCafe.com service, all users are required to provide 100% true and accurate information when registering for an account and completing any third-party offers. Providing false information is fraud and will result in the termination of your FreeCashCafe.com account. Only one member of each household may register for a FreeCashCafe.com account, and accounts may not be shared. Additionally, your computer must not be shared with another individual that has an existing FreeCashCafe.com account. You are solely responsible for keeping your FreeCashCafe.com account and password confidential. You may not use another user's account at any time. FreeCashCafe.com will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. Users must not use proxy servers under any circumstances. Violating any of the aforementioned policies will result in the termination of your FreeCashCafe.com account and forfeiture of all earnings accumulated from the FreeCashCafe.com website. Termination of an account does not merit the creation of a new account.

Payments

Payments will normally take 15 days to process, assuming the user has met the minimum payout of seven US dollars. FreeCashCafe.com makes no guarantees regarding the timeliness of payments in the event of interferences which affect FreeCashCafe.com's ability to make payments. These interferences, include but are not limited to, late payments by the third-party advertisers, technical difficulties, and errors committed by the US Postal Service. Users must understand that payments come from revenue generated by third-party advertising companies. Therefore, you acknowledge and agree that if an advertiser does not pay FreeCashCafe.com, FreeCashCafe.com reserves the right to indefinitely withhold the user's share of revenue. FreeCashCafe.com reserves the right to audit individual accounts and terminate accounts involved in fraudulent activity on a case-by-case basis at our sole discretion.

Inactivity

The FreeCashCafe.com owners and/or administrators may terminate any user's account which has been inactive (not logged in) for 90 consecutive days. All decisions regarding termination are final.

Third-Parties

FreeCashCafe.com is not responsible for any content provided by third-parties; your voluntary participation in their campaigns is regulated by their separate terms and policies. FreeCashCafe.com will never charge you membership fees, but some third-parties may require you to make a payment in order to complete their offer. Users are solely responsible for any charges incurred by participation in third-party programs.

Limitation of Liability

You expressly understand and agree that FreeCashCafe.com is not liable for any direct, indirect, incidental, punitive, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in any way related with your use of or performance of FreeCashCafe.com service and/or website, whether based on contract, negligence, or strict liability. If you are not satisfied with any portion of the FreeCashCafe.com service and/or website, it is your sole responsibility to discontinue using the FreeCashCafe.com service and website.

Non-Commitment

FreeCashCafe.com does not have any commitment toward any users, past or present. FreeCashCafe.com may at anytime, for any reason, with or without notice, discontinue the FreeCashCafe.com service. Even after such discontinuation, FreeCashCafe.com remains without commitment to any users, past or present, of the FreeCashCafe.com website.

Indemnification

You agree to hold harmless and indemnify FreeCashCafe.com, its affiliates, agents and all users from and against any third-party claim arising from or in any way related to your use of the website, including, but not limited to, any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs, and attorneys' fees of every kind and nature. You also understand and agree that FreeCashCafe.com may disclose personally identifiable information if required to do so by law or in a situation that such disclosure is reasonably necessary to comply with legal process, enforce the FreeCashCafe.com Terms of Service, or protect the rights, property, or the safety of FreeCashCafe.com, its users, and the public.

Governing Law

This agreement will be governed by the laws of the United States, without reference to rules governing choice of laws. Any legal action relating to this agreement or other services of FreeCashCafe.com must be brought to the courts in Monmouth County, New Jersey, and you consent to the jurisdiction of such courts. Use of the FreeCashCafe.com service and website is unauthorized in any jurisdiction that does not give effect to all provisions of this agreement, including, without limitation, this paragraph.
